Terms of Service

1. Agreement to Terms

By accessing or using O-1 Assist (“the Service”), operated by O-1 Assist (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

O-1 Assist is a petition preparation tool that helps users organize evidence, receive AI-powered assessments, and generate materials for O-1A extraordinary ability visa petitions. The Service includes document upload and classification, criterion-by-criterion strength assessments, petition support letter generation, recommendation letter templates, and an annotated Form I-129 guide.

3. Not Legal Advice

O-1 Assist is not a law firm and does not provide legal advice or legal representation. The Service is an organizational and preparation tool. Use of the Service does not create an attorney-client relationship. All materials generated by the Service are starting points and should be reviewed by a licensed immigration attorney before submission to USCIS. We make no guarantees regarding the outcome of any visa petition.

4. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. You are responsible for all activity under your account.

5. Payment and Pricing

Access to the Service requires a one-time payment of $104 USD. Payment is processed securely through Stripe. All fees are non-refundable. Prices are subject to change, but any change will not affect existing paid accounts.

6. User Content

You retain ownership of all documents, data, and information you upload to the Service (“User Content”). By uploading User Content, you grant us a limited license to process, store, and analyze it solely for the purpose of providing the Service to you. We will not share, sell, or use your User Content for any other purpose.

7. AI-Generated Content

The Service uses artificial intelligence to classify documents, assess evidence strength, and generate petition materials. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all generated materials for accuracy before use. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

8. Prohibited Uses

You may not:

• Use the Service for any unlawful purpose or to submit fraudulent petitions
• Upload documents containing malware or malicious code
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Resell or redistribute the Service without written permission
• Upload content that infringes on third-party intellectual property rights

9. Limitation of Liability

To the maximum extent permitted by law, O-1 Assist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Account Termination

You may delete your account at any time, which will permanently remove your data from our systems. We reserve the right to suspend or terminate accounts that violate these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
